Terms of Service & End User License Agreement

Welcome to Nostalgius. These Terms of Service and End User License Agreement (the “Terms”) are a binding agreement between you and Ernesto Gomez (“Nostalgius,” “we,” “us,” or “our”), the operator of the Nostalgius mobile application and related services (the “Service”). Nostalgius is based in Texas, United States.
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. By using Nostalgius, you represent that you are 13 or older and that you are able to form a binding contract with us. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian.
2. Your account
You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly at ernestogotu@gmail.com if you believe your account has been compromised.
3. Your content and the license you grant
You own your content. You retain all rights to the photos, videos, captions, and other content you create and share on Nostalgius (“Your Content”).
License to operate the Service. To provide the Service, you grant us a limited, non-exclusive, royalty-free, worldwide license to host, store, reproduce, display, and distribute Your Content solely as needed to operate and provide the Service to you and to the other users you choose to share it with (for example, people you tag or the audiences you select in your privacy settings). This license ends when Your Content or your account is deleted, except for content others have lawfully saved or re-shared, and except for any copies we must retain for a limited time for legal or safety reasons.
Your responsibilities. You are solely responsible for Your Content and represent that you have the rights necessary to share it, and that it does not violate these Terms or the rights of others (including privacy and intellectual property rights). Be thoughtful about sharing photos and information about other people, especially minors.
4. Acceptable use and zero tolerance for objectionable content
Nostalgius has a zero-tolerance policy for objectionable content and abusive behavior. You agree that you will not post, share, or transmit content, or engage in conduct, that:
- Is unlawful, harmful, threatening, abusive, harassing, defamatory, or hateful
- Is sexually explicit or pornographic, or sexualizes minors in any way
- Depicts or promotes violence, self-harm, or dangerous or illegal activity
- Harasses, bullies, intimidates, or targets any individual or group
- Infringes anyone’s intellectual property, privacy, or other rights
- Impersonates any person or misrepresents your affiliation with any person or entity
- Contains spam, scams, malware, or attempts to compromise the Service or other users
- Violates any applicable law or regulation
You also agree not to share content depicting or involving other people without appropriate regard for their privacy and consent.
Enforcement. We do not tolerate objectionable content or abusive users. The Service provides tools to report content and users and to block other users. We review reports and will act on objectionable content and abusive behavior — including removing content and suspending or terminating the responsible accounts — and we aim to act on valid reports within 24 hours. We may take these actions at our discretion and without prior notice where appropriate to protect our users.
By using the Service, you agree to these terms of acceptable use as a condition of access.
5. Reporting and blocking
If you see content or behavior that violates these Terms, please use the in-app reporting tools, or contact us at ernestogotu@gmail.com. You can also block other users to stop them from interacting with you or seeing your content. We rely on these reports to help keep the community safe.
6. Termination and account deletion
You may stop using the Service and delete your account at any time from within the app (Settings → Account → Delete Account). Deletion follows the process described in our Privacy Policy, including a 30-day period during which you can reactivate your account before it is permanently finalized.
We may suspend or terminate your access to the Service, or remove content, at any time if you violate these Terms, if we are required to by law, or if we reasonably believe it is necessary to protect the Service or other users.
7. Intellectual property in the Service
The Service itself — including its software, design, logos, and branding (but excluding Your Content and other users’ content) — is owned by Nostalgius and its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the app for its intended purpose, subject to these Terms. You may not copy, modify, reverse engineer, or create derivative works of the Service except as permitted by law.
8. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that content shared by users is accurate or appropriate. You use the Service at your own risk.
9. Limitation of liability
To the maximum extent permitted by law, Nostalgius and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Nostalgius and its operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or the rights of others.
11. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Texas, unless applicable law requires otherwise.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
13. Apple App Store — Additional Terms
These additional terms apply if you download the app from the Apple App Store:
- These Terms are between you and Nostalgius (Ernesto Gomez) only, not with Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide any maintenance or support for the app.
- In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims.
- Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the app infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.
